To **toll** a legal time limit is to suspend its running for a period recognized by law. Tolling can affect the calculation of a [[Statute of Limitations|statute of limitations]], but it is not a general permission to ignore a deadline or restart the clock whenever a dispute continues. ## In California Family Law The reason for the pause must fit the applicable rule. For example, [Code of Civil Procedure section 356](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=CCP&sectionNum=356.) excludes time during which an injunction or statutory prohibition stays the commencement of an action. It does not mean that every order in a pending family case pauses every related deadline. Tolling and delayed accrual are related but different concepts. A discovery rule may postpone when a limitations period starts. The California Courts' [deadline guidance](https://selfhelp.courts.ca.gov/civil-lawsuit/statute-limitations) explains that the particular claim and circumstances matter. Neither negotiations nor simply being unaware of a deadline establishes an automatic pause. Some family-law claims have their own timing provisions. [Family Code section 1101(d)](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=FAM&sectionNum=1101.) generally measures a specified fiduciary-duty claim from actual knowledge of the transaction, but provides an exception for an action brought with dissolution, legal separation or nullity, or upon a spouse's death. It also preserves a laches defense. Those provisions should not be recast as a rule that marriage tolls every claim. **Example:** A spouse learns of a disputed transaction and assumes that discussing settlement has stopped the filing clock. The deadline still requires analysis of the particular claim, its accrual and any actual tolling or statutory exception. The settlement discussion alone does not answer that question. ![[Files/OtherFiles/Toll.jpg]]
