## Rule excerpts
Welfare and Institutions Code sections 361, 362.4, and 364: custody exit orders upon termination of dependency jurisdiction, distinguished from dispositional removal.
> However, section 361 findings are required at the disposition stage of dependency proceedings. The statute does not apply to custody and visitation determinations made at a section 364 review hearing concurrent with the termination of juvenile court jurisdiction.
— J.M., In re (2023) B313754, slip op., p. 26.
> Instead, section 362.4 governs the court’s authority to issue exit orders determining custody and visitation of a child when terminating jurisdiction at a section 364 hearing. (§ 362.4, subd. (a); In re Roger S. (1992) 4 Cal.App.4th 25, 30.) Section 362.4 does not require a finding of detriment under any circumstances; as a result, courts have applied the best interest standard in determining appropriate custody and visitation exit orders at this stage.
